Trademark Registration Certificate

What is a Trademark Registration Certificate?

A Trademark Registration Certificate is an official document issued by the Turkish Patent and Trademark Office (TÜRKPATENT) that certifies the registration of a trademark as a distinctive sign for goods or services.
This certificate grants the trademark owner the exclusive right to use the mark and provides legal protection against unauthorized use.

Purpose of the Trademark Registration Certificate

  • Prevent the use of the trademark by others without permission

  • Ensure legal protection of the trademark

  • Increase the commercial value of the trademark and provide assurance to investors

  • Enable the transfer of commercial rights such as licensing, assignment, or franchising

Protection Period and Renewal

  • Protection period: 10 years from the date of registration

  • Renewal: Can be renewed before expiration or within 6 months after expiration; each renewal extends protection by 10 years

  • Perpetual protection: The trademark can be protected indefinitely as long as it is renewed

What Does the Trademark Registration Certificate Provide?

  • Legal Monopoly Right: Only the trademark owner can use the registered mark

  • Right to Oppose: Ability to oppose applications for similar trademarks by others

  • Legal Protection: Ability to file lawsuits, request product recall, and claim damages in case of infringement

  • Commercial Value: The trademark can be licensed or assigned as a tangible asset

Trademark Registration Process (Example for Türkiye)

  1. Research: Check for similar trademarks before applying

  2. Application: Apply to TÜRKPATENT (via e-Government or through a trademark attorney)

  3. Formal Examination: Application documents and form are checked

  4. Publication: Trademark is published in the Official Trademark Bulletin for 2 months (opposition period)

  5. Registration: If no opposition is filed or if oppositions are rejected, the trademark is registered and the certificate is issued
